Westbrook Housing Authority Environmental Review: July 16, 2020 and July 23, 2020 Combined Notice of Finding of No Significant Impact and Intent to Request a Release of Funds On or about August 3, 2020, the Westbrook Housing Authority will submit a request to HUD for the release of federal funds under Section 8 Project Based Voucher Program authorized by Section B(0)(13) of the U.S. Housing Act of 1937 (42 U.S.C. 14371(o)(13)) as amended, to undertake the following project: The Hunton Court subdivision was approved by the Westbrook, Maine Planning Board on August 21, 2018. Hunton Court is a 5.22 acre tract of previously undeveloped land approved for two phases of mid-rise residential development (the "Project"). Phase l is known as the Robert L Harnois Apartments and consists of a single building housing 61 units of low-income senior apartments for Westbrook residents age 62 and over. Phase II, known as the Lewis H. Emery Apartments, is comprised of 30 units of low-income senior in a single mid-rise building and will also serve low-income Westbrook Seniors in need. The subject site, while surrounded by adjacent urban development and centrally located in the City of Westbrook and highly convenient to urban amenities, was not previously developed. Phase I construction, for which a prior environmental review was conducted, commenced in the fall of 2019 and completion is anticipated in December of 2020. Phase Il is slated to start in the fall of 2020 and achieve completion in late 2021. Both phases, comprising 91 total units, financed with a combination of equity secured through the sale of low-income housing tax credits, locally allocated FedHOME supported funding, and'or sub-market amortizing and deferred debt through MaineHousing the Federal Home Loan Bank of Boston, and Gorham Savings Bank. Westbrook Housing Authority has placed 61 project-based housing vouchers at Phase I Harnois Apartments as well as 20 project-based vouchers at Phase II Emery Apartments to provide critically needed access to quality affordable housing to Westbrook's lowest income seniors. Total Funding of $2.655, 180 in Federal Housing Assistance Payments has been allocated to Phase I Harnois Apartments and $870,550 in Federal Housing Assistance Payments has been allocated to Phase II Emery Apartments. Finding of No Significant Impact. The Westbrook Housing Authority, by and through its lead entity, the City of Westbrook, has made an environmental assessment for this project and has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Ervironmental Policy Act of 1969 is not required for either project. Release of Grant Fund. City of Westbrook certifies to HUD that Jerre Bryant as City Manager or Michael Foley as Mayor in his official capacity, consents to accept the junisdiction of the Federal courts if an action is brought to enforce responsibilities in relation to the environmental review process, and that these responsibilities have been satisfied. HUO's approval of the certification satisfies its responsibilities under NEPA and allows the City of Westbrook and Westbrook Housing Authority to the program funds noted above. Objections to Release of Funds. HUD's Region I. Manchester, NH office will accept objections to its release of funds and the City of Westbrook certification for a period of fiteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if it is on one of the following bases: (a) the certification was not executed by the Chief Executive Officer of City of Westbrook; (b) the ERR indicates omission of a required step, decision or finding required by HUD regulations at 24CFR part 58;: (c) the grant recipient or other participants in the project has committed funds and incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by the HUD Region I, Boston, MA office; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a writen finding that the project is unsatisfactory from the standpoint of environmental quality.
